These Terms of Service (“Terms”) govern your use of dannyyates.com(the “Site”) and any landscaping, irrigation, hardscaping, lighting, or nursery services provided by Danny Yates Landscaping (“we,” “us,” or “our”). By using the Site or engaging us for work, you agree to these Terms.
Danny Yates Landscaping is a Florida business operating at 425 SW Pine Island Road, Cape Coral, FL 33991. We have served Lee County since 1986 and provide residential and commercial landscape services.
You may use the Site for personal, non-commercial purposes - to learn about our services, browse the nursery yard inventory, read blog content, and request a free estimate. You agree not to:
All estimates are provided in writing after a property walk-through and are valid for 30 days unless stated otherwise. Estimates are based on the scope described at the time of the visit; changes to scope, site conditions uncovered during the work (irrigation issues, drainage problems, hidden obstructions), or material price changes can adjust the final cost. Any change-orders will be reviewed with you before work proceeds.
We perform all work in accordance with industry standards and applicable Florida and Lee County codes. We coordinate permits where required and handle HOA submissions when relevant. Workmanship is performed by our own crews and licensed sub-contractors.
Plant warranty terms vary by item and are listed on each written estimate. Sod, plants, palms, and specimen trees carry distinct warranty periods that assume proper irrigation, fertilization, and customer care after install. Warranties do not cover damage from storms, freezes, vehicle traffic, insufficient watering, neglect, or third-party work performed after our installation. Workmanship on hardscaping and irrigation systems is warranted as stated on the relevant estimate.
Payment terms are stated on each written estimate or invoice. We accept major credit cards, ACH transfers, and checks. Past-due balances may accrue interest at the rate allowed by Florida law. Returned-check fees apply where assessed by our bank.
We understand schedules change. If you need to reschedule a maintenance visit or installation date, contact our office at least 24 hours in advance when possible. Cancellations of confirmed installations within 48 hours of the scheduled start may be subject to a re-mobilization fee, which will be discussed before any charges are applied.
We may photograph completed installations for our portfolio, marketing, and social channels. We never include identifying information (homeowner names, full street addresses, license-plate detail) without written permission. If you prefer your property not be photographed, let us know before the install begins and we’ll honor that request.
All Site content - text, photographs, illustrations, logos, layouts, and code - is owned by Danny Yates Landscaping or licensed for our use, and is protected by copyright and trademark law. You may not copy or redistribute the content without permission.
To the fullest extent permitted by Florida law, our liability for any claim arising out of services we provide is limited to the amount you paid for the specific service in question. We are not liable for indirect, incidental, consequential, or punitive damages. The Site and its content are provided on an “as-is” basis without warranties of any kind beyond those expressly stated.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or our services will be resolved in the state or federal courts located in Lee County, Florida.
We may update these Terms periodically. The “Last updated” date above reflects the most recent change. Continued use of the Site or our services after a change indicates acceptance of the updated Terms.
